Heard. The Managing Director of Tamil Nadu State Transport Corporation Limited, Villupuram Division has suffered an award of Rs.2,79,000/- as against the claim of Rs.5,00,000/- made by the legal heirs of the deceased in M.C.O.P.No.203 of 2005 on the file of the Motor Accident Claims Tribunal (Subordinate Judge), Madurantakam. When the award was passed almost six years ago, namely, on 2.10.2010, it is not known why the Transport Corporation has not taken any steps whatsoever and kept quiet for such a long time to bring up the matter on appeal. That shows that they wanted to drag on the matter to deny the payment of compensation to the legal heirs of the deceased. Therefore, considering the huge and unexplained delay of 1616 days in re-presenting the appeal, C.M.P.No.13897 of 2016 stands dismissed. C.M.A.No.SR52595 of 2011 stands rejected.
2. In any event, four weeks time is granted to the Managing Director of the petitioner-Transport Corporation to deposit the entire award amount along with interest to the credit of M.C.O.P.No.203 of 2005 on the file of the Motor Accident Claims Tribunal (Subordinate Judge), Madurantakam. On such deposit, it is for the claimants to withdraw the entire amount along with interest by moving appropriate application before the Tribunal. 12.09.2016 ss
