a) To pass a preliminary decree declaring the 1/4th share of the plaintiff in the suit property namely, Plot No.3968, S-Block, No.36/1, 16th 1/4

Street, Anna Nagar, Chennai-600 040 morefully described in the schedule hereunder;

b) grant a permanent injunction restraining the defendants, their agents, servants, men or any body claiming through or under them, from in any manner, from carrying out any alterations to the physical features of the suit property c) To pay the cost of the suit;

J U D G M E N T

When the matter is taken up for hearing today, the learned counsel for the defendants 1to 3 submitted that the defendants 1 to 3 are willing for partition and the suit may be decreed by allotting 1/4th share each to the plaintiff and the defendants 1 to 3 in the suit property and he has also made an endorsement to that effect.

2. In view of the aforesaid submission and endorsement made by the learned counsel for the defendants 1 to 3, a preliminary decree is passed for partition of the suit property into four equal shares and allot one such share to the plaintiff and the defendants 1 to 3 are entitled to the remaining three shares and their share will be allotted on payment of Court Fee as required under law. Considering the relationship between the parties, there shall be no Order as to cost.
