The above C.M.P. is filed to condone the delay of 899 days in filing the appeal suit.

Though the respondent has not been served, we are inclined to condone the delay on payment of costs of Rs.10,000/- (Rupees Ten thousand only) by the petitioner in favour of "Cancer Institute, Adyar, Chennai" on or before 05.06.2023 failing which the miscellaneous petition shall stand dismissed automatically without any further reference to this Court.
