Defendants PRAYER: Civil Suit filed under Order VII Rule 1 of Code of Civil Procedure read with Order IV Rule 1 of Madras High Court Original Side Rules for the following reliefs :

(a) Issuing specific performance of direction to the first defendant to execute sale deed of the suit schedule property as per the oral agreement in favour of the first plaintiff subject to acceptance of the balance sale consideration of Rs.3,00,000/- (Rupees Three Lakhs Only) from the plaintiff failing which this Court may execute the sale deed in favour of the first plaintiff;

(b) Permanent injunction restraining the defendants, their agents, 1/4

servants, men acting under the defendants from interfering with peaceful possession and enjoyment of the suit schedule property; (c) Permanent injunction restraining the defendants from alienating, encumbering the suit schedule property by way of lease, mortgage, sale, settlement or by any other mode pending disposal of the Civil Suit;

(d) Cost of the suit.

J U D G M E N T

It is stated by the learned counsel for the plaintiffs that the matter has been settled between the parties.

2.The plaintiffs and the defendants filed a Memo of Compromise dated 15.10.2023 signed by both parties and seek a decree in terms of Memo of Compromise.

3.In view of the compromise entered into between the parties, 2/4

this Suit is disposed of in terms of the Memo of Compromise entered into between the parties. The Memo of Compromise shall form part of the decree. No costs. Consequently, the connected original applications are closed. 4.Registry is directed to return the Court fee, as per law. 19.10.2023 TK 3/4
