Heard the learned counsel for the petitioner/appellant. Though the delay has not been properly explained, from and out of the given judgment, the respondent herein, has filed an appeal in S.A.No.89 of 2020 which is pending.

Therefore, this petition is allowed and the delay of 1196 days in filing the above appeal in S.A.Sr.No.27445 of 2023 is condoned, on condition that the learned counsel for the appellant shall pay a cost of Rs.2000/- in favour of the Tamilnadu Advocates' Clerks' Association on or before 13.03.2024 and for reporting compliance on 14.03.2024.
