O R D E R
1. The instant Writ Petition has been filed seeking for regularization.
2. The learned counsel for the respondent would bring to the knowledge of this Court about the adjudication of the similar matter by the Hon'ble Division Bench of this Court in W.P.Nos.5245, 5258 and 5257 of 2020 dated 08.03.2024. By and in which, this Court had given liberty to the petitioners therein to approach the Labour Court. The relevant paragraphs of the order is extracted hereunder:
5. There are rival contentions. We do not find any document placed on record to prove that the petitioners are working with the respondents. The petitioners are admittedly not paid ex gratia for the years 2005-2006 and 2006-2007, not are they paid ex gratia for the year 2010-2011. In the absence of any document, it will not be possible to consider the case of the petitioners.
6. The petitioners may approach the competent Labour Court or such other forum as may be permissible in Law to agitate their grievances. In that event, all contentions of the petitioners and the respondents are kept open.
3. The learned counsel for the petitioner would also concede the above factum of adjudication of similar matter.
4. Therefore, in the light of the above order , this Writ Petition is disposed of giving liberty to the petitioner to approach the competent labour Court, or any other appropriate forum as may be permissible in law.
