No.3642 of 2014 dated 06.08.2019 on the file of the Motor Accidents Claims Tribunal/IV Court of Small Causes, Chennai. U.Pooja Shree (minor) rep. By her father and natural guardian Mr.S.Umapathy .. 3. K.S.Ramesh Babu (1st Respondent remained ex-parte before the Tribunal) .. Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Ms. Ramya V. Rao, learned counsel for the Appellant, Mrs.R.Srividhya, learned Advocate for the 2nd respondent ICICI Lombard General Insurance Company Ltd. are present.

After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows: TERMS OF SETTLEMENT The Tribunal has awarded a sum of Rs.50,000/- with interest at 7.5% per annum from the date of filing of the petition till the date of deposit. Aggrieved by the award of the Tribunal, the appellant has preferred the present appeal.

2. It is a case of injury and since the appellant being a minor, she appeared along with her father and agreed to the terms of compromise. Accordingly, after due deliberation and consultation, both the parties have agreed to settle the case for a sum of Rs.2,20,000/- (Rupees Six lakhs only) over and above the award amount already deposited, in full quit, as enhanced compensation.

3. The 2nd respondent/Insurance company shall deposit the modified award amount of Rs.2,20,000/- (Rupees Two lakhs twenty thousand only), less the amount already deposited, if any, within a period of eight weeks from the date of receipt of a copy of this order.

4. On such deposit being made, the appellant's father is permitted to withdraw a sum of Rs.2,20,000/- along with the amount already deposited, in full quit, before the Tribunal without filing any formal petition. The Award is passed accordingly.

5. The Tribunal is directed to transfer the amount through RTGS/NEFT to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition.
