JUDGMENT

On 15.03.2021, the issues in the Appeal had been referred to the Mediation and Conciliation Centre at Chennai, for an effort to be made to settle the issues.

2.The Mediation and Conciliation Centre has now forwarded a report dated 26.03.2021, enclosing a Settlement Agreement entered into between the parties on 25.03.2021. A copy of the Settlement Agreement has also been filed along with the report. It has been signed by the appellant and the respondent and also by the learned counsel for the appellant and by the learned counsel for the respondent.

3.It had been stated that the respondent had agreed that, in view of the settlement, the appeal may be allowed and the judgment and decree in O.S.No.872 of 2019 on the file of the XVIII Additional City Civil Court, Chennai dated 13.11.2019 may be set aside.

4.The said agreement entered into between the parties is also affirmed by the learned counsels who are present today. The Appeal is allowed in terms of the Settlement Agreement entered into between the parties before the Mediation and Conciliation Centre. No order as to costs. Consequently, connected Civil Miscellaneous Petition is closed. The appellant is entitled for refund of Court fees in accordance https://hcservices.ecourts.gov.in/hcservices/

with Rules. The Settlement Agreement entered into between the parties shall form part of the decree.
