ORDER

This Company Petition has been filed under Section 433(e) read with Section 434(1)(a) and 439(1)(b) of the Companies Act, 1956 to direct the respondent be wound up and to direct the Official Liquidator attached to this Hon'ble Court be appointed as Liquidator of the assets, properties, income and business of the respondent and also to order that the costs of the petition be provided for.

The learned counsel for the petitioner would submit that this Court has already passed an order dated 17.10.2016 in C.P.No.123 of 2016 to wound up the respondent-Company and hence, no further order is required in this petition. Therefore, he requests this Court to dismiss the present petition by granting liberty to the petitioner to file appropriate claim before the learned Official Liquidator.

3. In view of the above submission, nothing survives in this Company petition. Hence, this Court is inclined to dismiss this petition.
