ORDER

The petitioner/A1, who was arrested and remanded to judicial custody on 10.12.2025, for the alleged offence punishable under Sections 296(b), 103(1) of BNS, 2023 in Crime No.489 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that due to previous enmity, the petitioner along with her husband went to the house of the deceased and attacked him with knife, and slit the throat, thereby causing grievous injuries, as a result of which the deceased died immediately. Hence, the petitioner was arrested and remanded to judicial custody.

3. The learned counsel for the petitioner submitted that the deceased has abused the accused relative hence quarrel with him during the quarrel the said occurrence had taken place, and already A2 in this case was granted bail. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate(Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is the main accused who is the one who attacks the deceased with knife and A2 granted bail on the basis of overt act attributed against her and the

investigation in this case is pending. Hence, he opposed grant of bail to the petitioner.

5. I have gone through the earlier order passed by this Court and FIR and other connected materials, which revealed that the petitioner herein has slit the throat of the deceased in this case and caused brutal murder and it is not a case of sudden quarrel and it is a premeditated and the investigation is pending, hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
