ORDER

The petitioner, who was arrested and remanded to judicial custody on 16.01.2026, for the alleged offence punishable under Sections 115(2), 118(1), 296(b) and 351(3) of BNS Act 2023 in Crime No.16 of 2026 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner herein was involved in attacking his mother with chair due to a sudden quarrel and caused severe injuries. Hence, she was admitted to the hospital, and a complaint was lodged, and she was discharged from the hospital after 20 days. Hence, the petitioner has been arrested.

3. The learned counsel for the petitioner submitted that the petitioner has been in custody for more than 30 days and the injured has been discharged from the hospital and is ready to co-operate with the investigation. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has caused severe injuries to his mother and that some vital parts were injured; she was discharged from the hospital after a long period, and the

petitioner also has one previous case under Section 302 IPC. Hence, he opposed the grant of bail to the petitioner.

5. Considering the manner in which the occurrence had taken place and the fact that the petitioner has caused severe injuries to his mother and also has bad antecedents of one previous case of murder, hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
