Writ Petition filed under Article 226 of the constitution of India to issue a Writ ,order or direction in the nature of Writ, declaring the action of the first respondent refusing to consider the soft tennis sports certificates of the years 201516 & 2017-18 i.e. a. 9th Junior State Level Soft Tennis

Championship for the academic year 2015-16 (80 Marks) b. 10th Junior State Level Soft Tennis Championship for the academic year 2017-2018 (95 Marks) issued to the petitioner and to award and add the said marks to the petitioner for the admission to the course of Bachelor of Veterinary Science & Animal Husbandary BVSc & AH (5 YEARS) Tamil Nadu Veterinary And Animal Science University Chennai for the academic year 2018- 2019 under Sports Quota Boys as illegal and consequently direct the 1st respondent to consider the same and add the 175 sports marks along with 290 sports marks which.

W.M.P.No.21245 of 2018:

Petition filed to direct the 1st respondent to consider the following soft tennis sports certificates of the years 2015-16 & 2017-18 i.e. a. 9th Junior State Level Soft Tennis Championship for the academic year 2015-16 (80 Marks) b. 10th Junior State Level Soft Tennis Championship for the academic year 2017-2018 (95 Marks) issued to the petitioner and add further 175 sports marks and place him in the 4th place in the provisional sports quota rank list for the admission to the course of Bachelor of Veterinary Science & Animal Husbandary BVSc & AH (5 YEARS) Tamil Nadu Veterinary And Animal Science University Chennai for the academic year 2018- 2019 under Sports Quota Boys pending disposal of the main writ petition.

JUDGMENT

(Judgment of the court was made by HULUVADI G.RAMESH, J.) Heard the learned counsel appearing for the appellant and Mr.C.Munusamy, learned Special Government Pleader, who takes notice on behalf of respondents 1 and 2.

2. The writ appeal is filed as against the interim order passed by the learned Single Judge in declining to grant a direction pending disposal of the main writ petition.

3. It appears that the appellant/writ petitioner, being a soft tennis player and had played at State and National Level and acquired various certificates and medals during the years 2014-2018 and based on that, he claims awarding of additional marks to gain upper ranking position in the selection process to Bachelor of Veterinary Science & Animal Husbandry course (BVSc & AH) for the academic year 2018-2019 under the sports quota and his grievance is that the national level certificate secured by him alone were considered for granting additional marks.

4. Be that as it may, considering the fact that the order passed by the learned Single Judge is only on the interim

application and the main matter itself is pending consideration, we request the learned Single Judge would take up the main matter itself for disposal within a period of three months, on merits and in accordance with law. It is open for the appellant to raise all his contentions before the learned Single Judge. The claim made by the appellant to keep one seat reserved also could be considered by the learned Single Judge. The writ appeal is disposed of accordingly.

No costs.
