dated 05.09.2019 issued by the 2nd respondent, the enquiry report made in PR.No.23/19 U/r.3(b) dated 14.09.2020 submitted by the 4th respondent, the consequential second show cause notices made in B2/PR.07/2020 dated 29.09.2020 and 29.10.2020 and impugned order dated 05.01.2021 made in Range Order No.03/2021 in Na.Ka.No.P2/Tha.Pa.07/2020 issued by the 2nd respondent quash the same and consequently direct the respondents to pay regular salary with all attended benefits.

O R D E R
Heard the learned counsel for the petitioner and the learned Special Government Pleader appearing on behalf of the respondents and perused the records.
2. The petitioner by this writ petition has assailed the correctness of the order dated 05.01.2021 issued by the 2nd respondent.

When the writ petition is taken up for hearing, the learned counsel appearing for the petitioner fairly submitted that during the pendency of the present writ petition, the petitioner had submitted a representation to the Director General of Police, Chennai to set aside the punishment awarded to 2/7
him under the impugned proceedings; and that the Director General of Police, Chennai (for short "DGP") vide his proceedings dated 16.06.2023 was pleased to set aside the order by which he was visited with punishment.
4. The learned counsel for the petitioner further submitted that the Director General of Police, Chennai while setting aside the punishment awarded to the petitioner, directed for payment regular salary with all attendant benefits.

The learned counsel for the petitioner submitted that though the respondent was directed to pay the regular salary with all benefits due to him for the earlier period, the same have not been granted till date, despite the petitioner had opted for VRS, the respondents permitted him to retire vide proceedings dated 30.06.2025 by treating as "retirement on superannuation" with effect from 30.06.2025.

The petitioner contended that since, the petitioner is permitted to retire under VRS, he is entitled for the benefits under the scheme nor any pension has been paid, if treated as retired on superannuation as stated in the impugned proceedings. Thus, the petitioner prays that the respondents be 3/7
directed to consider the payment of attendant benefits for the earlier period of punishment and the retirement benefits due from 01.07.2025.

The learned Special Government Pleader appearing on behalf of the respondents submitted that since, the Director General of Police, Chennai, vide proceedings dated 16.06.2023 had accepted the revision filed by the the petitioner by setting aside the punishment awarded to him, he would be entitled for the regular salary and also the attendant benefits.

The learned Special Government Pleader would further submit that since, the petitioner was allowed to retire from 30.06.2025, the petitioner can approach the respondents authority seeking attendant benefits and any other amounts due to him under VRS or on being allowed to retire on superannuation w.e.f. 30.06.2025.
9. I have taken note of the submissions made as above.
10. The main grievance of the petitioner in the present writ petition stands redressed on account of the passing of the impugned proceedings by the Director General of Police, Chennai on 16.06.2023. However, taking 4/7
note of the submissions made on behalf of the petitioner that the regular salary and attendant benefits as directed in the order of DGP having not been paid and also the retirement / pensionary benefits have not been granted, this Court is of the view, the petitioner should be directed to approach the concerned authority and submit a representation detailing the amounts due to him within a period of two weeks from the date of receipt of a copy of this order and upon the petitioner submitting the aforesaid representation, the respondents authority are directed to disburse/grant all the attendant benefits/ regular salary / retirement benefits which are otherwise due and payable to the petitioner, if not already paid, within a further period of eight (8) weeks therefrom.
11. Subject to the above observation and directions, this writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
