prayer: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent police to provide adequate and necessary police protection to the said Pudiya MGR Nagar Mattrum Viruvu Paguthi Kudisai Vazhvor Munnetra Sangam and its election officer to conduct the election for the new office bearers of the Sangam to be held on 19.08.2018 between 8.00 a.m. 5.00 p.m. at the Sangam premises at MGR Nagar, Manali, Chennai on the basis of the request dated 11.08.2018 in accordance with law. ORDER
The petitioner has approached this Court, seeking the following relief:- "To issue a Writ of Mandamus directing the respondent police to provide adequate and necessary police protection to the said Pudiya MGR Nagar Mattrum Viruvu Paguthi Kudisai Vazhvor Munnetra Sangam and its election officer to conduct the election for the new office bearers of the Sangam to be held on 19.08.2018 between 8.00 a.m. and 5.00 p.m. at the Sangam premises at MGR Nagar, Manali, Chennai on the basis of the request dated 11.08.2018 in accordance with law." 2.It is the case of petitioner that he has been appointed as the Election Officer, to conduct the Election for Pudiya MGR Nagar Mattrum Viruvu Paguthi Kudisai Vazhvor Munnetra https://hcservices.ecourts.gov.in/hcservices/
Sangam on 9.08.2018 and therefore, the petitioner has come up with the prayer seeking Police protection.
3.Heard learned counsel for the petitioner and the learned Government Advocate (Criminal side) and Mr.K.Ponpandian, Sub Inspector of police, Manali Police Station, is present. 4.On instructions, the Government Advocate (Crl.Side) submitted that there are rival groups which are opposing the conduct of the elections by this petitioner. Admittedly, the elections are not being held on the directions of any Court. Under such circumstances, this Court cannot give a direction as prayed for by the petitioner. However, the respondent police shall ensure that there is no law and order problem in that area and it is open to the respondent police to take appropriate action against any one who breaches the law.
