ORDER
The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420, 465, 468, 471 of IPC in connection with the Cr.No.6 of 2026, seeks anticipatory bail.
2. The allegation against the petitioner is that petitioner herein is ranked as A4 in this case. A1 is the brother of the defacto complainant in
this case and originally, their father was having a land to the extent of 1786 sq.ft and after his demise, A1 with the help of A2 and A3, fabricated fake Patta and Adangal as if the land belongs to A3 and subsequently, on the strength of Patta and Adangal, sale deed was also executed in favour of A2/wife of A1. In the said sale deed, this petitioner subscribed his signature as a witness. Hence, the petitioner is also added as an accused.

Learned counsel for the petitioner submitted that all the other accused were arrested and released on bail and this petitioner were only acted as witness to the document and he has not benefitted from any of the transactions. He further submits that the petitioner is ready to cooperate with the investigation and abide by any condition that may be imposed by this Court and prays for grant of anticipatory bail to the petitioner.
4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and on instructions, submitted that the investigation in this case is still pending and hence, she opposed for grant of anticipatory bail to the petitioner.
5. Heard both sides and perused the materials available on record.

Considering the facts and circumstances of this case, the submissions made by the learned counsel appearing on either side, limited role attributed against the petitioner herein and also that the other accused are released on bail, this court is inclined to grant anticipatory bail to the petitioner, with certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date on which the order copy made ready, before the learned Judicial Magistrate Court-II, Ponneri, Chennai, on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further conditions that:
[a] the petitioner shall report before the respondent police daily at 10.30 am., for a period four weeks and thereafter as and when required for interrogation.
[b] the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer or tamper with the evidence; [c] the petitioner shall not abscond either during investigation or trial.
[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[e] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 B.N.S.2023.
