( Criminal Jurisdiction ) Friday, the Twenty Fifth day of March Two Thousand Twenty Two PRESENT The Hon`ble Mr Justice G.CHANDRASEKHARAN CRIMINAL MISCELLANEOUS PETITION No.3915 of 2022 IN CRL.A.No.490 of 2019 S.MUTHAIAH [ PETITIONER / APPELLANT ] Vs THE INSPECTOR OF POLICE [ RESPONDENT ] CBI-SPE/CBI/ACB/CHENNAI Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed in order dated 05.09.2019 in Crl.M.P.No.10750 of 2019 in Crl.A.No.490 of 2019 to appear before the Hon`ble XI Additional Special Court for CBI Cases Once every three months, pending disposal of the above Crl.A.No.490 of 2019. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.B.

NATARAJAN, Advocate for the Petitioner and of MR.K.SRINIVASAN, Special public Prosecutor for CBI Cases on behalf of the Respondent the court made the following order:- This is a petition to relax the condition imposed by this Court in Crl.M.P.No.10750 of 2019 in Crl.A.No.490 of 2019 on 05.09.2019. In and by which condition, the petitioner was directed to appear before XI Additional Special Court for CBI Cases once in every three months. 2.

Learned counsel for the petitioner submitted that petitioner is aged about 80 years, he is suffering from chronic Heart ailment and other chronic ailments associated with the age. Hence, he finds it difficult to comply with the condition.

Learned Special Public Prosecutor for CBI Cases appearing for the respondent concedes that the petitioner is regularly complying with the condition.

Considering the fact that the petitioner is aged about 80 years and that he claims to have Heart ailment and other disease associated with the age, this Court is inclined to relax the condition totally.
