O R D E R

The petitioners herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(4), 336(2), 336(3), 340(2), 61(2) of BNS Act, 2023 in Crime No.43 of 2026, on the file of the respondent Police, seeks anticipatory bail.

The allegation against the petitioners is that the petitioners herein are ranked as A1 to A4 and originally land was abetter, in favour of the defacto complainant in this case as early as 1994 and it is a vacant land and taking advantage of the vacancy, this petitioners have fabricated allotment order of the Slum Clearance Board and also No Objection Certificate for developing the land and subsequently, A2 to A4 executed a release deed in favour of A1 so as to document their illegal activities. Hence, the case has been registered.

The learned counsel for the petitioners submitted that in this regard, two suits are pending between the parties, one in the year 2019 and subsequently in the year 2005 and they were in possession of the property. He further submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that they collected reply from the Slum Clearance Board regarding veracity of the documents produced by the petitioner herein and it revealed that documents were fabricated and investigation is pending. Hence, he opposed for grant of anticipatory bail to the petitioners.

5.Considering the nature of allegations and the fact that the petitioners were involved in fabrication of records, and usurped the property of the defacto complainant and at this stage if anticipatory bail is granted, it will hamper the investigation, this Court is not inclined to grant anticipatory bail to the petitioners.

6. Accordingly, this Criminal Original Petition is dismissed. 23.02.2026 sma 3/5
