After the matter was argued at length, both the parties agreed to submit themselves to an Arbitration once again.
2. The matter was adjourned on 02.01.2020 for them to revert with the name of the Arbitrator today. Today when the matter was called, both counsel who have appeared suggested the name of Hon'ble Mr. Justice N. Paul Vasanthakumar, retired Chief Justice of the Jammu & Kashmir, High Court.
3. Considering the above submissions, this Court appoints Hon'ble Mr. Justice N. Paul Vasanthakumar retired Chief Justice of the Jammu & Kashmir, High Court as the Arbitrator in respect of the dispute between M/s. Visen Industries Limited and M/s. PKN Metal Buildings Company Private Limited. The Arbitral Tribunal shall de 2/5
novo hear and pass an award on the dispute. Accordingly OP is allowed. No costs. Consequently, connected Miscellaneous Petitions are closed.
