ORDER

The petition has been filed to direct the 2nd respondent to consider the petitioner's representation dated 30.06.2025 and to take effective measures to conduct an enquiry and cancel the legal heir certificate dated 10.11.2024 bearing the Certificate No. TN- 7202410281647 and issue a fresh legal heir certificate.

2. It is the case of the petitioner that he was married to one Mrs.Rani on 14.06.1970 and the couple had no children. Out of goodwill, they took care of the 3rd respondent who is none other than the daughter of the sister of the petitioner's wife. Thereafter, due to health issues, the petitioner's wife died on 30.07.2024, due to which, the petitioner went to Kanchipuram to stay with his brother for emotional support. When the petitioner went to the house of the 3rd respondent and requested her to return his belongings, jewellery, cash and bank related documents, to his shock and surprise, she refused to return the items and forced him out of her residence.

3. Therefore, the petitioner lodged a complaint before the police, where during enquiry, the 3rd respondent produced the death certificate, legal heir certificate and claimed herself as the daughter of the couple. Aggrieved by the

same, the petitioner made a representation before the 2nd respondent seeking cancellation of the false legal heir certificate. Till date, no action has been taken, aggrieved by which, the petitioner is before this Court.

4. Heard the learned counsel on either side and perused the materials available on record.

5.Considering the relief now sought for by the petitioner, this Court, without going into the merits of the case, directs the second respondent to consider the petitioner's representation dated 30.06.2025, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order. It is needless to state that the enquiry shall be conducted only after issuing notice to the 3rd respondent as well and the orders shall be passed after hearing both the parties.
