O R D E R

This petitioner has been filed under Section 11 of the Contempt of the Courts Act, 1971 praying to punish the respondent herein for committing disobedience of the order of this Court dated 18.01.2016 made in Crl.O.P.No.964 of 2016.

2. This Court by an order dated 18.01.2016 has directed the second respondent to conduct enquiry on the complaint given by the petitioner and dispose of the same

in accordance with law, as early as possible. Since, the said order was not complied with, the present contempt petition has been filed.

3. When the matter is taken up for hearing, the respondent has filed a counter affidavit stating that on the complaint given by the petitioner, a case was registered in Crime No.69 of 2016, under Sections 454 and 380 of IPC on 01.04.2016 at about 9.00 A.M. On completion of investigation, the case was referred to as 'Mistake of Fact' in R.C.S.No.3 of 2016 dated 05.04.2016 and the same was also served on the petitioner.

4. In view of the fact that since R.C.S was served on the petitioner,nothing survives for adjudication in this petition. Hence, this contempt petition is closed.
