Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in CRL A.587/2017 on the file of the High Court, the High Court will be pleased to suspend the order of sentence inflicted on the Appellant/accused in CC.No.23 of 2012 passed by the XII Additional Special Judge for CBI Cases, City Civil Court, Chennai on 18.08.2017 till the disposal of the CRL A.587/2017 [IN CRL.MP.NO.11610 OF 2017] Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in CRL A.587/2017 on the file of the High Court and upon hearing the arguments of M/S.V.S.VENKATESH, Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- Seeking to suspend the sentence imposed on the petitioner by the learned XII Additional Special Judge for CBI cases, City Civil Court, Chennai dated 18.08.2017, in C.C.No.23 of 2012 and enlarge the petitioner on bail pending disposal of criminal appeal, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Special Public Prosecutor (CBI cases) appearing for the respondent.
3. It is submitted by the learned counsel for the petitioner that the case registered against the petitioner under the provisions of Prevention of Corruption Act is certainly exaggerated. The petitioner being a private candidate has been convicted. Points for arguments in the appeal establishes innocence of the petitioner. The fine amount has already been paid and the petitioner is entitled for
suspension of sentence.
4. In the light of the above facts, I am inclined to allow this miscellaneous petition and the order passed by the XII Additional Special Judge for CBI cases, Chennai dated 18.08.2017 in C.C.No.23 of 2012 is suspended on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties each for a like sum to the satisfaction of the learned XII Additional Special Judge for CBI cases, City Civil Court, Chennai. Further, the petitioner shall appear before the trial Court on every first working day of every month at 10.30 a.m until further orders.
