Writ petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, calling for the entire records relating to the impugned order passed by the 1st Respondent in his proceedings Na.Ka.819/2014 Sa.Pa dated 15.04.2014 and quash the same.

O R D E R

The learned Special Government Pleader would submit that the petitioner has challenged the impugned show cause notice issued by the first respondent in the present writ petition. https://hcservices.ecourts.gov.in/hcservices/

2 At the time of admission, this Court granted interim order on condition that the petitioner shall pay a sum of Rs.2 lakhs on or before 6.6.2014. The said conditional order has not been complied with by the petitioner. Subsequently, on 16.4.2015, the first respondent has passed the Surcharge order under Section 87 of the Tamilnadu Co-operative Societies Act for recovery of Rs.5,45,400/- with further interest at the rate of 18% p.a. 3 In view of the award passed by the first respondent, the counsel for the petitioner seeks liberty to challenge the said award before the tribunal under Section 152 of Tamilnadu Co-operative Societies Act.

4 In view of the above, the writ petition is dismissed as infructuous. However, liberty is granted to the petitioner to file an appeal before the tribunal. No costs.
