Prayer: Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 2 to 4 to make necessaries entries in the revenue records viz., Chitta, Adangal and other revenue records including computer records and issue separate computer patta in the name of petitioners in S.No.14/2 and 14/3, situated at Chettichavadi Village, Salem Taluk, Salem District.

ORDER

The prayer sought for herein is for a writ of Mandamus, directing the respondents 2 to 4 to make necessary entries in the revenue records viz., Chitta, Adangal and other revenue records, including computer records and issue separate computer patta in the name of petitioners in S.No.14/2 and 14/3, situated at Chettichavadi Village, Salem Taluk, Salem District.

2. The petitioners had been issued free patta, i.e, land assignment, some time in 1999 at Chettichavadi Village. However, for several years, no consequential action to make an entry in the revenue records have been undertaken. Therefore, in order to make the said mutation of the revenue records, including the Chitta, Adangal and Computer patta, these petitioners have already approached the 2/6

revenue officers of the District concerned and in this regard, the representation submitted on behalf of the petitioners to the District Collector, having been considered, was forwarded by his communication dated 21.01.2021 to the Revenue Divisional Officer ie., the second respondent herein for appropriate action with a copy marked to the third respondent / Tahsildar. However, so far, no action seems to have been taken and nothing was forthcoming from the second and fourth respondent. Therefore, the petitioners joined together and filed this writ petition with the aforestated prayer.

3. Heard Mr.M.R.Jothimanian, learned counsel appearing for the petitioners and Mr.P.Sathish, learned Additional Government Pleader appearing for the respondents.

Mr.P.Sathish, learned Additional Government Pleader would submit that, even these petitioners have already been issued patta long years back, mutation to be made in the revenue records is the only consequential action, for which, if the petitioners have already given representation to the District Collector, which has been forwarded to the second and third respondent, that would be looked into and accordingly, the needful would be done by the second and third respondents within 3/6

a time frame that may be stipulated by this Court.

5. Considering the said submissions made by the learned Additional Government Pleader, this Court is inclined to dispose of this writ petition with the following directions:

There shall be a direction to the second and third respondents to take up the representation given by the petitioners, which has been forwarded by the first respondent / District Collector vide his proceedings dated 21.01.2021 in Na.Ka.1900/2021/K.Po and do the needful by effecting the mutation in the revenue records, including the Chitta, Adangal and Computer patta and that work shall be completed by the second and third respondents within a period of eight weeks from the date of receipt of a copy of this order.

6. With these directions, the writ petition is disposed of. There will be no order as to costs. Consequently, the connected miscellaneous petition is also closed.
