This application has been filed to set aside the ex-parte order dated 16.02.2022 passed in the above suit.

2. It is noted that when the matter came up before this Court on 16.02.2022, there was no representation on the side of the applicants/defendants and they had also not filed the written statement, even after giving sufficient opportunities and hence they were set ex-parte by this Court on 16.02.2022.

3. Now the applicants/defendants came with this application to set aside the ex-parte order dated 16.02.2022 and they have also filed an application to condone the delay of 879 days in filing the written statement, which is not yet numbered.

4. Though the reasons stated in the accompanying affidavit for the reliefs sought for in this application are not satisfied, however, in order to give an opportunity to the applicants/defendants to defend the suit, this application is allowed on payment of cost of Rs.50,000/-. 1/2 https://www.mhc.tn.gov.in/judis

5. The applicants/defendants are directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand Only) before the Registry to the credit of C.S.No.486 of 2019 on or before 27.04.2022. On such deposit, Registry is directed to take the application seeking to condone the delay in filing the written statement on file, if it is otherwise in order.
