O R D E R

When the matter was taken up for hearing the learned counsel for the petitioner submitted that, this Court by its order dated 26.11.2021 issued direction to the 3rd respondent to issue notice to the petitioner while opening the lock of the temple and the passage towards the big hill and the same has to be served to the petitioner 48 hours prior to the opening of the lock of the temple and the passage of the big hill. He further submitted that, the notice was served initially to the petitioner, however, the Hundial was opened on 8 different occasions, thereafter, and no notice was served to the petitioner. Hence, the present contempt petition is filed.

2.The contemnor/ respondent appeared before this Court and submitted that, she took charge as Executive Officer on 27.11.2020 and was not aware of the notice that has to be served to the petitioner before opening the Hundial and the passage to the big hill she further submits that, Mr. Mohanasundaram, Assistant Commissioner, Trichy Division, was the former Executive Officer of Arulmigu Lakshmi Narasimhar Swamy Devasthanam, Sholinghur, Ranipet District-631102. Therefore, contempt notice was issued against the said Mr.Mohanasundaram and he was directed to appear before this Court today i.e., 10.12.2020.

3. The said Mr.Mohanasundaram/contemnor appeared before this Court

today, and agreed to comply with the order of this Court and gave undertaking to serve the notice properly to the petitioner, 48 hours prior to the opening of the lock of the temple and the passage of the big hill. It is further submitted that notice was issued to the petitioner, but due to pandemic, there were certain constraints and, henceforth, notice will be duly issued to the petitioner.

4. In view of the fair submission made by the learned counsel for the petitioner and since the respondent/contemnor appeared before this Court and since they have agreed to implement the order of this Court dated 10.02.2020, this contempt petition is closed . Consequently, connected Miscellaneous petition is closed.
