ORDER

This writ petition has been filed to direct the official respondents to provide the petitioner with 40 feet passage for access to his unacquired lands

morefully described in the prayer to this writ petition.

2. According to the petitioner, in view of the land acquisition of the petitioner's remaining lands and other lands belonging to third parties, the present holdings of the petitioner, morefully described in the prayer to this writ petition, has now become land-locked. The petitioner claims that orally the official respondents have assured him that he will be provided with 10 feet passage, which is insufficient for the petitioner's free ingress and egress to his property.

3. The petitioner seeks for 40 feet passage in order to have free ingress and egress to his property, morefully described in the prayer to this writ petition. The petitioner had given a representation on 07.01.2026 to the official respondents, seeking for 40 feet passage to enable the petitioner to have free ingress and egress to his property morefully described in the prayer to this writ petition. Since the said representation has not been considered till date, this writ petition has been filed.

4. Mr. D.Ravichander, learned Special Government Pleader accepts notice on behalf of R1, R4 and R5, Mr. D.B.R. Prabhu, learned counsel accepts notice on behalf of R2 and R3 and Mr. B. Sanjay Balachander, Standing Counsel (CMDA) accepts notice on behalf of R6. Since no adverse orders are passed

against the respondents 7 and 8, notice to the respondents 7 and 8 is dispensed with by this Court.

5. No prejudice would be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance with law after hearing the necessary parties, which includes the respondents 7 and 8 within a time frame to be fixed by this Court.

6. This Court is not expressing any opinion on the merits of the petitioner's representation.

7. For the foregoing reasons, this Court directs the fifth respondent, who after consultation with the sixth respondent, shall pass final orders on merits and in accordance with law on the petitioner's representation dated 07.01.2026, seeking for grant of 40 feet passage to the petitioner to enable the petitioner to have free ingress and egress for the property morefully described in the prayer to this writ petition within a period of eight weeks from the date of receipt of a copy of this order after hearing the objections of the necessary parties which includes the respondents 7 and 8.

8. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is closed.
