O R D E R

The Writ Petition has been filed to call for the records in the order of rejection vide in Na.Ka.No.02/Ka.O.Aa/The.Ka.Ni/2023 dated 23.02.2023 passed by the 2nd respondent and to quash the same. Further to direct the 2nd respondent to grant permission for Orchestra on 04.03.2023 in Kovarthanakiri Sri Varatharaya Swami Temple, Anniyalam Village, Thenkanikottai, Krishnagiri District imperusant to the petitioner representation dated 23.02.2023.

Learned counsel for the petitioner submitted that petitioner submitted a representation dated 23.02.2023 for conducting orchestra on 04.03.2023 in Kovarthanakiri Sri Varatharaya Swami Temple, Anniyalam Village, Thenkanikottai, Krishnagiri District. That representation dated 23.02.2023 was rejected with a direction to get orders from this Court. Therefore, this petition.

3. Heard the learned Government Advocate (Crl.side) appearing for the respondent.

4. The rejection of permission stating that petitioner should get orders from this Court is not appropriate. Therefore, this Court is of the view that order of rejection vide in Na.Ka.No.02/Ka.O.Aa/The.Ka.Ni/2023 dated 23.02.2023 passed by the 2nd respondent has to be set aside and accordingly set aside. The respondent police is directed to consider the petitioner's representation dated 23.02.2023 in light of the detailed Circular Memorandum in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 issued by the Director General of Police, Tamil Nadu, Chennai, along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of applications seeking permission for conducting cultural programme and to pass suitable orders based on the above said circular.

5. With the above direction, this Writ Petition is disposed of. No costs.
