JUDGMENT

(Judgment of Court was made by V.DHANAPALAN,J.) When the appeal is taken up for hearing, learned counsel for the appellant would submit that the application filed by the appellant in I.A.No.1646 of 2012 in H.M.O.P.No.1125 of 2009 was rejected by the trial Court only on the ground of a defect in the application. Therefore, the appellant may be given liberty to approach the trial Court for rectification and proceed further. An endorsement to that effect is also made by the learned counsel for the appellant. The learned counsel for the respondent has not opposed to such a plea and the permission. Therefore, we dismiss the appeal as withdrawn granting liberty to the appellant to move the concerned trial Court for rectification. No costs.
