(Order of the Court was made by R.SUBRAMANIAN, J.) The petitioner seeks a Writ of Mandamus directing the respondents to consider his representation to remove the alleged unauthorized construction 2/6

put up by the 3rd respondent.

2.According to the petitioner, the 3rd respondent who was allotted 600 Sq.ft., of land by the Slum Clearance Board had put up construction for about 1200 Sq.Ft., by encroaching on all four sides of the property. 3.The learned counsel for the 3rd respondent would submit that the petitioner himself is a encroacher in the land of the Anganvadi Centre. If that be so, action should be taken both against the petitioner and the 3rd respondent. In fact, a lock and seal notice was issued by the 3rd respondent by the Chennai Corporation on 26.04.2021 and the 3rd respondent has also filed a revision before the Government under Section 80-A of the Tamil Nadu Town and Country Planning Act.

Since action has already been taken by the respondent against the 3rd respondent, this Writ Petition is disposed of with a direction to the Corporation to pursue action taken against the 3rd respondent till its logical conclusion. It is also stated that on 12.08.2022, notice has been issued to the 3/6

petitioner seeking removal of the encroachment. In the light of the above, the Corporation will take action against the petitioner also as per law and the proceed with the same to its logical conclusion. No costs. Consequently, connected miscellaneous petition is closed.
