This Petition has been filed to set aside the abatement of the above Second Appeal, caused due to the death of sole appellant P.Moorthy.

2. Heard the learned counsel for the petitioners and the learned counsel for the respondents and also perused the materials available on record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition and the submissions made by the learned counsels on both side, this petition is allowed.
