The Official Liquidator, Attached To The Honble High Court, v. Nil

Comp.A.No.79 of 2022 Comp.A.No.79 of 2022 M.SUNDAR, J., Captioned application has been taken out by the 'Official Liquidator attached to this Court' [hereinafter 'OL' for the sake of convenience and clarity] with a prayer to ratify the appointment of an Advocate for representing OL in Company Application Nos.186 to 188 of 2021 and for payment of fee and expenses of Rs.66,000/- to the Advocate for his professional services in these three applications.

2. Mr.Bavisetty Sridhar, learned 'Deputy Official Liquidator' [hereinafter 'Deputy OL' for the sake of convenience and clarity] who is before this Court submits that a 'report of OL dated 14.03.2022' [hereinafter 'said report' for the sake of convenience and clarity] has been filed in support of captioned application.

3. Adverting to said report, learned counsel submits that the aforementioned three applications pertain to Service Law issues and therefore, it was deemed appropriate to engage the services of a lawyer to represent OL.

4. This Court having perused said report, having heard learned Deputy OL and having noticed the facts and circumstances of this case, is satisfied that the prayer in the captioned application deserves to be acceded to as it is not only innocuous but imperative.

5. Captioned application ordered as prayed for making it clear that payments to learned advocate for OL shall be made after deducting Taxes at source (TDS) under the The Income-tax Act, 1961 (43 of 1961), if applicable and other statutory deductions if any. There shall be no order as to costs.
