Prayer: Writ Petition has been filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 herein to take appropriate action against the illegal running of the school Vidhya Vidyalaya Matriculation School, Yethapur Village, Salem District without recognition and consequentially take action in pursuance of their show cause notices dated 13.03.2024, 05.07.2024 and 16.10.2024.

The Writ Petition is filed by one Panimalar Educational Charitable Trust, represented by its Secretary and others.
2. The grievance of the petitioners is that they have a dispute with the private respondents regarding who would be the educational agency and who would be the trustee or the correspondent. Their further grievance is that the School which is run, namely, Vidhya Vidyalaya Matriculation School, Yethapur Village, Salem, is presently running with certain violations and even without the recognition. Already show cause notice were issued on 13.03.2024, 05.07.2024 and finally on 16.10.2024, as to why further action could not be taken since the institution has not even renewed its recognition. Even thereafter, no action is taken. Therefore, the petitioners are before this Court. Page Nos.3/7
3. When the matter came up for admission, the Learned Government Advocate, taking notice on behalf of respondents 1 to 3, submitted that the enquiry is pending pursuant to the show cause notice dated 16.10.2024 and that they will further continue the enquiry and pass final orders thereon.
4. In view of the nature of order that is passed, this writ petition is disposed of at the admission stage, without notice to the private respondents. This Court is not expressing any opinion on the merits or otherwise of the allegations that are mentioned in the writ petition. At the outset, it should be seen that as far as the inter se dispute between the petitioners and the private respondents is concerned, it should be sorted out before the appropriate Civil Court as to who will be the educational agency and who will be the Correspondent or the trustee as the case may be. That dispute cannot be escalated to the School authorities. It is submitted that the Educational Authorities have already issued show cause notices and submission is made that the enquiry will be continued and orders will be passed in accordance with law.

The writ petition is disposed of, recording the aforesaid submission and to complete the enquiry within a period of four months from the date of receipt of the web copy of the order, without waiting for the certified copy of this order. It is needless to mention that if any violation/requirement has to be Page Nos.4/7
rectified/fullfiled, an opportunity should also be given to rectify the violation.
6. With the above observations, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
