ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.01.2026 for the offences under Sections 110 of BNS and Section 9(B)(1) of the Indian Explosive Act, 1884 in Crime No.1 of 2026, registered on the file of the respondent police, seeks bail.

2.The case of the prosecution is that this petitioner has kept the country made bombs in the back side of the house and the son of the defacto complainant burst it, due to which he sustained severe injuries. Hence the case. 3.Earlier bail petition of the petitioner was dismissed on 05.02.2026 in Crl.O.P.No.2673 of 2026 on the following reasons: " 5.Considering the submissions made by the learned counsel appearing on either side; nature of offence; previous antecedents of the petitioner and taking note of the fact that the petitioner is a habitual offender, this Court is not inclined to grant bail to the petitioner."

4. The learned counsel for the petitioner submitted that the petitioner has been in incarceration for nearly 60 days; no final report has been filed so far and that the petitioner is ready to cooperate with the investigation. Hence, he prayed for grant of bail to the petitioner.

5. This Court had earlier dismissed the bail application taking into consideration the previous antecedents of the petitioner. It is now reported that the said previous antecedents are not linked with the possession of explosives,

hence, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned XXIII Metropolitan Magistrate, Saidapet, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity; [b] the petitioner shall report before the Trial Court daily at 10.30 a.m., for a period of three weeks.

[c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned

Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
