Respondent PRAYER: Criminal Miscellaneous Petition has been filed under Section 438 read with 442 of BNSS, 2023 praying to suspend the sentence imposed against the petitioner in trial in S.C.No.101 of 2022 on 07.10.2023 by the learned Principal Assistant Sessions Court, Tiruppur, and the conviction and sentence was confirmed in C.A.No.92 of 2025 on 16.12.2025 by the 1st Additional District and Sessions Court, Tiruppur and enlarge the petitioner on bail pending disposal of the Criminal Revision.

O R D E R

This Criminal Miscellaneous Petition has been filed to suspend the sentence imposed against the petitioner in trial in S.C.No.101 of 2022 on 07.10.2023 by the learned Principal Assistant Sessions Court, Tiruppur, and the conviction and sentence was confirmed in C.A.No.92 of 2025 on 16.12.2025 by the 1st Additional District and Sessions Court, Tiruppur and enlarge the petitioner on bail pending disposal of the Criminal Revision.

2. The allegation against the petitioner is a serious allegation of robbery and was punished under Sections 397 (2 Counts) and 397 read with 34 (2 counts) IPC and the trial Court imposed a sentence of 7 years rigorous imprisonment for each count to run consecutively. However, the Appellate Court has modified to sentence to run concurrently.

3. Considering the serious nature of the allegations and the concurrent findings of the Courts below, this Court is of the view that it is not a fit case to entertain the petition seeking suspension of sentence. 2 / 4
