Prayer: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 3 to pay the said sum of Rs.60,00,000/- as compensation for the misdeeds of respondents 6 to 8 and all the respondents be made liable jointly and severally. Mr.D.Ravichander, learned Special Government Pleader accepts notice for R1 to R4 and R8 and Mr.Rahul Aditya, learned counsel for Ms.P.T.Ramadevi, learned Standing Counsel accepts notice for R5 and both learned counsel are armed with sufficient instructions to proceed with the matter finally. In the nature of order that is passed in the paragraphs to follow, no notice is thought necessary to R6 and R7 at this juncture.
2. This writ petition is jointly filed by two writ petitioners i.e. wife and son of late S.Rajamani making various allegations as against the respondents 2 to 8 for dereliction of duty on various counts. As learned Special Government Pleader would rightly point out, the allegations levelled by the petitioners would involve determination of various facts and this exercise is thus best left to the respondents to undertake and pass appropriate orders.
3. A direction is thus issued to R1/the Chief Secretary, to depute a person of appropriate seniority, who would consider the averments/allegations contained in the legal notice that has been issued on 11.09.2021 which, in gist, sets out the grievances of the petitioners, and pass orders thereupon, within a period of four weeks from today. This order is passed specifically bearing in mind the advanced age of the first petitioner, stated to be in excess of 90 years.
