Prayer: Writ Petition filed Under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus, to call for the records of the first respondent in Pen.27/4/PT.1024/08-09/230 dated 03.12.2008 and quash the same as illegal, arbitrary and non est in law and consequently direct the first respondent to sanction Family Pension to the petitioner with interest at 1/4
the rate of 18% per annum with effect from 01.11.2011 till the date of payment of arrears of family pension.

When the matter was taken up for hearing on 25.03.2024, the learned counsel appearing for the petitioner has filed memo dated 25.03.2024 has taken on record by this Court and the same is extracted hereunder:- "1. It is submitted that the writ petition was instituted challenging the impugned order dated 03.12.2008 and for a consequential direction for sanction of the family pension with the interest at the rate of 18% per annum with effect from 01.11.2011.
2. It is submitted that when the matter came up for hearing, the Hon'ble Court had directed us to get instructions from the petitioner. Subsequently I had taken out notice seeking for instructions on 15.03.2024. All 2/4
efforts to contact the petitioner ended in vain as there was no instruction till date."
