This application is filed by the applicant/plaintiff to appoint a new Advocate Receiver in the place of Mr.D.Rajendran who was appointed by an order passed in OA.No.1130 of 2005 and who has passed away on 04.01.2014 with suitable directions for collecting the rents for the suit schedule property etc.,

2. Heard the rival submissions made on both sides and perused the available records.

3. This Court by an order dated 24.01.2006 made in OA.No.1130 of 2005 in CS.No.337 of 2003, appointed Mr.D.Rajendran as the receiver of the movable property, and of the rents, issues and profits of the immovable property mentioned in the suit schedule, with the power to get in and collect the outstanding debts and claims due in respect of the said properties. The said Advocate Receiver passed away on 04.01.2014. Hence, the applicant filed this original application to appoint new receiver in the place of deceased D.Rajendran.

4. This Court is inclined to allow this application by appointing Advocate Receiver.

Mr.M.Karthikeya Narayanan, No.137, Law Chambers, High Court, Chennai-104, Mobile 9444043313 is appointed as Advocate Receiver for the aforesaid purpose. The monthly remuneration of the Advocate Receiver is fixed at Rs.5,000/-p.m. (Rupees Five Thousand only) and the same shall be payable from the Estate. The Advocate Receiver is directed to file the statement from the last date of filing the statement by the erstwhile Receiver to till date and thereafter to file the statement of accounts once in three months before this Court.
