This petition has been filed seeking to condone the delay of 81 days in filing the above review application.
2. Mr.R.Suryanar Maheshan, learned counsel for petitioner submitted that due to illness, the petitioner unable to file the above Review Application in time. Hence, there is a delay of 81 days in filing the above Review Application and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.
3. Mr.M.A.Lakshmipathi, learned counsel for respondent would submit that the petitioner has not given sufficient cause to condone the delay. However, the suit is pending from the year of 2014 and now E.P. is also pending to execute the decree, at this stage, she came forward with this Review Application. Hence, he raised strong objections and prayed to dismiss this petition.
4. Considering the facts and circumstances and the fact that the suit is pending from the year of 2014 and to avoid further complications and the reasons stated by the petitioner in the affidavit seems to be justifiable one, this court is inclined to allow this petition and Registry is directed to number the Review Application if it is otherwise found to be in order and post the matter on 14.08.2024.
