Respondents Writ petition filed under Article 226 of The Constitution of India praying for the issuance of a writ of certiorarified mandamus to call for the records on the file of the second respondent in No.47388/K1/10 dated 13.01.2011 and quash the same as illegal, unjust, arbitrary, discriminatory and unconstitutional and direct the respondents to grant promotion to the petitioner as Assistant from the date of promotion given to his junior Mr.D.Rajendran together with all consequential promotions with all service and monetary benefits and consequently refix the seniority of the petitioner in the post of Sub Registrar in accordance with law. ORDER
Challenging the order of the second respondent dated 13.01.2011 and for a consequential direction to the respondents to grant promotion to the petitioner as Assistant from the date of promotion given to his junior Mr.D.Rajendran together with all consequential promotions with all service and monetary benefits and consequently refix the seniority of the petitioner in the post of Sub Registrar in accordance with law, the present writ petition has been filed.
2. When the matter was taken up for hearing, learned counsel for the petitioner submitted that he has no instructions from the petitioner and he has also made an endorsement to that effect in the Court bundle.
3. In view of the submission made by the learned counsel for the petitioner coupled with the endorsement made in the Court bundle, this writ petition is dismissed for non-prosecution. There shall be no order as to costs.
