JUDGMENT

For the sake of convenience, the appellant and the respondents will be referred to as the complainant and the accused respectively. 2.

The present appeal has been filed challenging the judgment of acquittal of the accused passed by the Judicial Magistrate, Fast Track Court at Magisterial Level II, Coimbatore (C.C.No.91/2012, Judicial Magistrate VI, Coimbatore) for the offence punishable under Sec.138 of Negotiable Instruments Act.

In view of the judgment of Full Bench of this Court in the case of S. Ganapathy vs N. Senthilvel reported in (2016) 3 MLJ (Crl) 641 (FB), Registry is directed to send the records to the Court of Principal District and Sessions Judge, Coimbatore, after taking photocopy of the same, within a period of four weeks from the date of receipt of a copy of this Order. 6.

The complainant is directed to appear before the learned Principal District and Sessions Judge, Coimbatore on 22.01.2018 at 10.30 a.m.
