The applicant asserts that these documents were not available with the applicant at the time of filing the plaint. It is further asserted that the said documents are relevant and, indeed, vital to the successful prosecution of the suit. The first respondent / first defendant has filed a counter on behalf of the first and second respondents. The respondents state that the documents are inadmissible in evidence and this application was filed with a view to protract the proceedings.

2. Upon considering the submissions, it should be noticed that the suit is at the pre-trial stage and that the documents in question are stated to be documents which were not in the power, possession, control or custody of the applicant when the suit was instituted.
