ORDER

This writ petition has been filed for direction directing the respondent to re-allot the commercial plot to the petitioner to an extent of 0.88 cents in CP-2 of SIDCO Industrial Estate, Thirumudivakkam, Chennai for construction of the super market under the Women Special Scheme.

2. The respondent originally allotted the subject plot in favour of one Nattesan. However, after allotment, the said Nattesan failed to pay the allotment amount and as such allotment was cancelled by the respondent. Therefore, the petitioner applied before the 2nd respondent for the allotment of commercial plot. The petitioner formed a group of women under the Women Special Scheme for construction and planning for establishment of supermarket. The petitioner sought for said plot and also she annexed a Demand Draft dated 16.10.2019 to the tune of Rs.14,590/- along with application dated 17.10.2019. However, the application has not been considered so far.

On perusal of the counter filed by the respondent revealed that on receipt of the said application and also the request made by the petitioner dated 11.01.2021 and 03.02.2021 to allot the commercial plot in favour of the petitioner was not considered since the application submitted by the petitioner for seeking allotment of plot was already returned as early as on 14.11.2019. However, if any vacancies arises it will be brought into commercial plot vacancy list notification by way of uploading it in the website of the respondent.

4. Therefore, whenever the vacancy is uploaded in the website of the respondent, the petitioner is at liberty to apply for fresh application. On receipt of the same the respondent is directed to consider the request made by the petitioner seeking allotment of Commercial Plot in favour of the petitioner.

5. With the above direction, this writ petition is disposed of. No order as to costs. Consequently, connected miscellaneous petition is closed.
