Seeking for a direction to try the Original Petition in O.P.No.564 of 2016 together with the suit in C.S.No.13 of 2015, the present application has been filed.

2.Learned counsel for the applicant and the learned counsel for the respondent submitted that in view of the suit filed in C.S.No.13 of 2015, the Original Petition in O.P.No.564 of 2016 has to be converted into Testamentary Original Suit and thereafter, both the matters can be tried together.

3.In such view of the matter, the application in A.No.4295 of 2016 is ordered, by converting O.P.No.564 of 2016 into Testamentary Original Suit and thereafter, both the matters could be tried together. 30.08.2016 mmi
