ORDER : The Court Made the following order :- It is a case of suicide committed by under-trial prisoner leaving a suicide note has lead to arrest of this petitioner. Though the incident took place in the year 2016, only after the transfer of investigation to CBCID and on receipt of the hand writing expert's report regarding the suicide note, the police has arrested this petitioner on 06.02.2022.

2. The learned counsel for the petitioner states that the petitioner is innocent and nothing to do with the suicide committed by the under-trial prisoner in the prison. However, the content of the suicidal note prima facie indicates that the deceased who was under-trial prisoner in a murder case had implicated this petitioner even in a case in which he was arrayed as an accused and imprisoned. Since further investigation is required, the release of this petitioner at this juncture will lead to tampering of evidence.
