ORDER

This Court, by an order dated 9.7.2013 in Crl.O.P.No.7723 of 2013, directed the respondent herein to conduct an enquiry in C.S.R.No.240 of 2012 and dispose of the same in accordance with law, as early as possible, preferably, within a period of three months from the date of receipt of a copy of that order. Alleging that the said order has not been complied with, the present contempt https://hcservices.ecourts.gov.in/hcservices/ petition has been filed.

2. Today, when the matter was taken up for consideration, learned Additional Public Prosecutor appearing for the respondent submitted that as per the direction of this Court, an enquiry was conducted by the respondent in C.S.R.No.240 of 2012 and the same was closed as civil in nature. A copy of the closure report has also been served on the learned counsel appearing for the petitioner.

3. Since the order of this Court has been complied with, I am of the opinion, nothing survives in this contempt petition and hence, the contempt petition is closed. However, if the petitioner is aggrieved over the closure report, he is at liberty to work out his remedy under Section 156(3) Cr.P.C., if he is so advised.
