ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.09.2025 for the offences punishable under sections 341, 302 of IPC, 126, 103 of BNS in Crime No.72 of 2022 in S.C.No.19 of 2023 on the file of the learned Additional Sessions Judge, Dharmapuri, seeks bail.

2. The petitioner was earlier arrested and released on bail. Subsequently, he jumped bail on 22.09.2025, and the Non Bailable Warrant was executed on 24.09.2025. Hence, the case.

3. The learned counsel for the petitioner submitted that due to sudden ill health of the petitioner's father, he was not able to appear, and he was looking after his family members. He further submitted that now the Non Bailable Warrant was executed, and is ready to abide by any condition imposed by this court. Hence prayed for grant of bail.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that due to his abscondance the trial was stalled. Hence, he opposed to grant bail to the petitioner.

5. From the submissions made by the learned Government Advocate (Crl.Side), this Court is able to know that the present case is posted on 12.03.2026 for 313 questioning. As Trial is an advance stage, this Court is of

the view that it is not desirable to enlarge the petitioner on bail. Accordingly, this Criminal Original Petition is dismissed. Consequently, connected miscellaneous petition is closed.
