This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents to consider the representation made by the petitioner on 27.12.2024 wherein the petitioner is seeking for removal of some of the trees and also to close the pit which is situated adjacent to the house belonging to the petitioner.

2. Heard Mr.R.Marudhachalamurthy, learned counsel for petitioner, Mr.M.R.Gokul Krishnan, learned Additional Government Pleader appearing for respondents 1 to 6 and Mr.Vinothraja, learned Government Advocate appearing for respondents 7 to 9.

3. The petitioner made a representation and based on the same, the third respondent issued proceedings dated 15.03.2017 and subsequent proceedings dated 17.11.2021 directing removal of the tree and to close the pit. In spite of the same, there was no progress. It is under these circumstances, the present writ petition came to be filed before this Court.

4. Learned Additional Government Pleader, based on instructions, submitted that the tree has been removed and the pit is now 3/6

covered by water and hence, the same will be closed within a period of two (2) weeks.

5. In reply to the above submission, the learned counsel for the petitioner submitted that the tree has not been removed and what has been removed is only some of the branches and the tree is intact which causes hindrance to the petitioner.

6. Taking into consideration the rival submissions, the fourth respondent will do the needful within a period of four (4) weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above direction. No costs.
