J U D G M E N T

This Civil Miscellaneous Appeal has been filed as against the order of injunction granted in I.A. No. 4085 of 2016 in O.S. No. 1496 of 2016 by the Trial Court on 14.03.2017. 2.

When the matter is taken up, learned counsel for the appellant would submit that after the filing of this appeal, the suit came to be dismissed for default and the application filed by the appellant to restore the suit was also dismissed.

When the suit itself has been dismissed, this appeal, which has been filed challenging an interim order of injunction granted during the pendency of the suit, has become infructuous. Hence, the appeal is dismissed as infructuous with liberty to the appellant to file appropriate proceedings, if he is so advised. No costs.
