ORDER

This writ petition has been filed for the issuance of a Writ of Mandamus to direct the respondents to appoint the petitioner in the post of Gang Man (Trainee) under the SC category vide notification issued by the third respondent in his Notification No.1 of 2019 dated 07.03.2019 consequently on par with other candidates who were all selected in the earlier appointment.

2. The petitioner who belongs to SC category had applied for the post of Gang Man (Trainee) and he obtained 48 marks. Irrespective of the petitioner belonging to any category his appointment can be done only in respect of the cut off marks determined for each and every category. So far the petitioner's category is concerned, it is stated by the third respondent who is a Chief Engineer (appointing authority) that the cut off mark

applicable to SC category is 64 marks. Since the petitioner had obtained only 48 marks which is far below the cut off, he cannot expect an appointment.

3. The petitioner has filed this petition due to his knowledge that some of the persons in SC category has been given with appointment. But that alone is not sufficient to canvass a claim that the petitioner has got the eligibility to be appointed as against the relevant category. It should also be shown that he has got the qualifying marks obtained in the selection process.

4. In view of the above, this Writ Petition lacks merit and hence dismissed accordingly. No costs. Connected miscellaneous petition is closed. 08.11.2023 Index: Yes / No Speaking order / Non-speaking order bkn
