JUDGMENT

The learned counsel for the appellant and the respondent confirms that the issue has attained finality by the judgment and decree passed by this Court on 11.02.2020 in S.A.No.1747 of 2001.

2.This appeal arises out of a subsequent suit filed by the appellant against the legal heirs of the sole defendant in the earlier proceedings which has now attained finality in S.A.No.1747 of 2001.

3.It is noticed that the respondent herein were also impleaded in S.A.No.1747 of 2001. Since the issue is now fully covered in favour of the appellant by the judgment and decree dated 11.02.2020, nothing survives for further adjudication in this appeal.
